Headquarters Agreement between France and the Pacific Community

The Agreement, concluded on 6 May 2003 and entered into force on 1 October 2011, establishes the Headquarters of the Pacific Community in France.

The Agreement also provides that, in the performance of its official activities, the Community enjoys immunity from legal process except: a) when the Director General of the Community has waived the immunity in a particular case; b) in civil proceedings for damages resulting from an accident caused by a motor vehicle of the Community or employed by the Community; c) for deduction of salary and emoluments payable by the Community to its staff members; d) counterclaims linked to proceedings instituted by the Community.

The Agreement also confers on officials, experts and consultants the immunity from legal process for the acts performed in their official capacity, and on the Director General and other senior officials the immunities accorded to diplomatic envoys.
