The Agreement, concluded between Venezuela and the United Nations Development Programme (UNDP), regulates the conditions under which the UNDP shall assist the Government in carrying out development projects, including the privileges and immunities of UNDP and its personnel in Venezuela.
UNDP, its property and assets shall be immune from any form of legal process, except insofar as in any particular case it has expressly waived its immunity (Article X).
UNDP resident representative and other senior officials shall enjoy the privileges and immunities granted to diplomatic envoys. UNDP Officials shall enjoy immunity from legal process in respect of the acts performed in official capacity (Article XII).
Experts on mission shall enjoy immunity from legal process in respect of the acts perpetreted in the performance of their mission (Article XIII).
The Secretary General of the United Nations shall have the right and duty to waive the immunity of any UNDP personnel in any case where, in his opinion, the immunity would impeede the course of justice and may be waived without prejudice to the interest of the organization (Article XVI).
