The Agreement, concluded between Italy and the International Plant Genetic Research Institute (IPGRI) in 1991, established the Headquarters of IPGRI and regulates its legal status, privileges and immunity in Italy.
The Agreement recognizes that IPGRI is an international organization possessing international legal personality.
As it provides, IPGRI shall enjoy immunity from every form of legal process except insofar as the Director General has waived such immunity in a particular case. The Staff of IPGRI is immune for the acts performed in official capacity. The Director General is entitled to diplomatic immunities. The Institute has the right and the duty to waive the immunity of any official and employee where the immunity would impede the course of justice, and it can be waived without prejudice to the interests.
IPGRI shall cooperate at all times with the appropriate authorities of Member States to facilitate the proper administration of justice, secure the observance of police regulations and prevent the occurrence of any abuses in connection with the privileges, immunities and facilities.
The Agreement also the obligation to provide appropriate procedure for the settlement of dispute between IPGRI and its staff members.
