The United States Lines Inc, a shipping company, brought a legal action before the Civil Court of Manila against the World Health Organization (WHO), seeking compensation for the undue permanence of a cargo in Manila’s port.
The WHO appeared before the Civil Court and filed a motion to dismiss the case on the grounds of the jurisdictional immunity granted to it as a specialized agency of the United Nations under the Convention on Privileges and Immunities of the Specialized Agencies of the United Nations and under the Headquarters Agreement concluded between the Government of the Philippines and WHO in 1951. The Civil Court upheld the motion.
The United States Lines Inc. appeal the Civil Court’s decision, advancing two main arguments. Firstly, the appellant objected the legal validity of the Headquarters Agreement of 1951, as it has not been ratified in accordance with the constitutional requirements concerning the conclusion of treaties. Secondly, the appellant claimed that the respondent organization, by appearing in the proceeding, had implicitly waived its jurisdictional immunities from legal process.
The Intermediate Appellate Court rejected the appeal and declared that national courts lacked jurisdiction to settle the dispute brought against the WHO. In particular, the Court stressed that it was not necessary to assess the legal status of the Headquarters Agreement, since the jurisdictional immunity of the WHO is granted under the Convention on Privileges and Immunities of the Specialized Agencies of the United Nations. The Court also highlighted that appearance in domestic legal proceedings does not entail an implicit waiver of international organizations’ jurisdictional immunity.
