The Host Country Agreement between the Government of the Republic of Turkey and the Economic Cooperation Organization Educational Institute (ECOEI) relating to the rights, privileges and immunities of the ECOEI, signed on 23 July 2020 and entered into force on 6 May 2022, regulates the legal status of ECOEI in the Host Country.
The ECOEI shall within the international recognized norms and practices on diplomatic conduct, rights and privileges have the the capacity to conclude contracts, to acquire and dispose of immovable and movable properties, to initiate legal proceedings (Article 3).
The ECOEI and its property and assets enjoy immunity from every form of legal process except insofar in any particular case the President of the ECOEI has waived this immunity (Article 6). The President shall have the right and duty to waive this immunity in any case where, in his opinion, the immunity shall impede the course of justice and can be waived without prejudice to the interest of the ECOEI.
The President of ECOEI shall enjoy the immunities accorded to diplomatic agents under the 1961 Vienna Convention on Diplomatic Relations. Personnel of ECOEI, who are not national of or resident in the Host Country, shall enjoy the same immunities as are accorded to diplomatic personnel of comparable rank. The President may waive these immunities in any case where, in his opinion, the immunity shall impede the course of justice and can be waived without prejudice to the interest of the ECOEI. The President shall take every precaution to ensure that no abuse of immunity shall occur (Article 10).
