The report of the Special Rapporteur of the International Law Commission clarifies the scope and goals of the ILC’ work on the settlement of disputes to which international organizations are parties. In particular, it evaluates whether the ILC’s studies should cover disputes of a private law character. The Special Rapporteur notes that these disputes give rise to several questions of international law such as the issue of jurisdictional immunity of international organizations and the obligation to provide alternative dispute resolution mechanisms. The report also addresses other preliminary issues such as the identification of the notion of international organizations and international organizations’ legal personality.
