The case originated from an employment dispute instituted before Brazilian courts against the United Nations and the United Nations Development Programme (UNDP). The dispute was dismissed on the ground of the immunity from legal process granted to the respondent organization under theConvention on Privileges and Immunities of the United Nations.
The applicant filed an appeal to the Federal Supreme Court, claiming a conflict between the Convention and the national Constitution.
The Supreme Court rejected the appeal, stressing that, as determined in its jurisprudence, the Convention, which confers on the United Nations absolute immunity from legal process, does not conflict with the Constitution.
