Agreement between the Republic of Austria and the International Organization for Migration on the legal status of the Organization and its Headquarters in Austria

The Agreement, concluded on 27 December 2013 and entered into force on 1 August 2014, defines the status of the International Organization for Migration on the legal status of the Organization and its Headquarters in Austria.

It recognizes the international legal personality of the organization and provides the organization and its property with immunity from legal process except: a) the organization has waived its immunity in any particular case; b) in respect of civil actions for damages arising from traffic accidents; 3) in cases of attachment, pursuant to a decision of a judicial or administrative authority, of the salary of emoluments owed by the Organization to a Staff member.

Staff Members enjoy immunity in respect of acts performed in official capacity. The Head of Office are entitled to the same immunities accorded by Austria to diplomatic envoys.
